Terms & Conditions

These Terms are a binding agreement between you and BIGSMS Pty Ltd trading as Orderitz. If you use Orderitz on behalf of a business (a venue), you confirm you are authorised to bind that business.

Orderitz lets you scan a venue’s QR code, view its menu, receive a predicted order, and send your chosen order to the kitchen or bar. Predictions are suggestions only; you are responsible for reviewing and confirming every order before it is placed.

• You must provide accurate information and keep it current.
• You are responsible for activity under your account.
• Keep your login credentials secure and notify us of any breach.
• You must be at least 16 years old to use Orderitz.

Menus, availability and prices are set by venues and may change without notice. When you confirm an order, you agree to pay the stated price plus any applicable taxes or fees. Orders are transmitted to the venue, which is responsible for preparing and serving them.

Because food is often prepared immediately, orders generally cannot be cancelled once accepted by the venue. Refunds for incorrect or unsatisfactory orders are handled by the venue in line with local consumer law. Orderitz will help mediate where we can.

Orderitz filters menus using allergen data provided by venues and the allergy profile you set. This is an assistive tool, not a medical guarantee. Kitchens may change recipes or suffer cross-contamination. If you have a severe allergy, you must always confirm directly with venue staff before eating. To the extent permitted by law, Orderitz is not liable for allergen exposure arising from venue error or undisclosed ingredients.

You agree not to:

• Use Orderitz for any unlawful or fraudulent purpose.
• Interfere with, probe, or attempt to disrupt the service.
• Scrape, reverse-engineer, or resell any part of the platform.
• Submit false orders or impersonate others.

Orderitz, the Orderitz signal mark, “MRS”, and all related software and content are owned by BIGSMS Pty Ltd and protected by law. We grant you a limited, personal, non-transferable licence to use the app for its intended purpose.

Orderitz is provided “as is”. We work hard to keep it accurate and available, but we do not warrant that predictions will be correct, that menus are error-free, or that the service will be uninterrupted.

To the maximum extent permitted by law, Orderitz’s total liability for any claim is limited to the amount you paid through the service in the three months before the claim. We are not liable for indirect or consequential losses. Nothing in these Terms excludes rights you have under mandatory consumer law (such as the Australian Consumer Law).

You may close your account at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm to others or to Orderitz.

These Terms are governed by the laws of New South Wales, Australia, and the courts there have non-exclusive jurisdiction, subject to any local consumer-law rights you cannot waive.
